Rules of Law and Evidence. Joinder of Parties. Parties may be compelled to participate in arbitration proceedings only by agreement. Thus, if any additional parties are necessary for complete relief, those other parties either must have agreements requiring such participation or otherwise must consent to their joinder in the proceedings.
In contrast, in court proceedings, all persons and entities involved in a dispute typically can be joined as parties. Appeal Rights. An arbitration award is final and binding and, in many jurisdictions, there is a limited right of appeal, even if the arbitrator makes a mistake of fact or law. Unlike the conventional arbitration based on pre-dispute agreement of the parties, the UCCA concept is a post-dispute arbitration agreement.
The concept proposes to cap cost at a minimum and allows parties to agree in advance that they each bear their own respective cost. While in the judicial officer arbitration, a nominal fee will have to be paid to the court. The concept also proposes a time-line for completion of the arbitration and accompanying rules for a swift and quick disposal of the matter. The courts have over the time become too rigid with a thick set of procedural and technical rules.

The arbitration will be conducted by a mix of adversarial and inquisitorial system or as parties may choose. It will relieve courts of case load as generally there is no appeal from an arbitration award. It will save a lot of public cost in administration of justice.
Added benefits to the parties will include that the award will enforceable in about countries, by virtue of legislations made in line with New York Convention The scheme addresses and resolves the two major setbacks of arbitration, namely high cost and delays. In Glasgow at COP26, world leaders debate the ways to avoid an environmental catastrophe later in the century. Even though the case covers many significant legal issues, one of them is of particularly high importance for the arbitration community.
